The majority of workers’ compensation, personal injury, and insurance claims are resolved by way of settlement between the opposing parties.  However, there are instances in which those claims must be resolved by way of a trial, in which a judge decides the legal issues, and a jury decides the factual issues and awards damages if it finds in the claimant’s favor.  In the workers’ compensation system, the Workers’ Compensation Court Judge decides both the legal and factual issues, and enters an order that informs the injured worker of his or her right to benefits under the Workers’ Compensation Act.

Trials are generally expensive, time-consuming, and wrought with uncertainty.  They can lead to months, if not years, of appeals before the parties know the final outcome of a particular claim.  The attorneys at Carey Law Firm nevertheless believe that every case must be prepared as if it will go trial, and we leave no stone unturned in investigating, prosecuting, and successfully resolving our clients’ cases, whether that resolution occurs in the course of settlement or trial.

Varco LP, in which a federal jury awarded their client $8.1 million in compensatory and punitive damages in contract and misappropriation of trade secrets action.
